Can my employer fire me after a work injury?

Answer:
Yes. Iowa is an employee at will state and generally your employer can fire you for any reason or no reason. If you are fired for an illegal reason (race, age, color, sexual orientation, because you filed a workers compensation claim, etc.) then there may be an employment law case that you can file. Also, if you are a member of a union then you may be able to file a grievance in order to get your job back. Keep in mind that if your employer does fire you because they cannot accommodate your work restrictions, then this will have a significant impact and will likely greatly increase the value of your workers compensation claim if you have an unscheduled injury (back, neck, shoulder, brain, etc.) or a Second Injury Fund case.

(WARNING: THESE ARE GENERAL STATEMENTS AND ARE NOT INTENDED AS LEGAL ADVICE OR LEGAL OPINIONS. IF YOU THINK THAT YOU HAVE AN EMPLOYMENT LAW CLAIM THERE ARE DEADLINES WHICH CAN BE AS SHORT AS ONLY A FEW DAYS TO FILE A GRIEVANCE OR ONLY A FEW MONTHS TO FILE A COMPLAINT WITH THE CIVIL RIGHTS COMMISSION OR EQUAL EMPLOYMENT OPPORTUNITY COMMISSION. IF YOU THINK YOU HAVE AN EMPLOYMENT LAW CASE THEN YOU SHOULD CONSULT WITH AN ATTORNEY RIGHT AWAY.)
